On February 23, 2024, the United States Department of Commerce issued a Final Limited General Applicability Nonavailability Waiver of the Build America, Buy America (BABA) preference requirements for the Broadband Equity Access and Deployment (BEAD) Program. This waiver mandates that specific categories of products must be manufactured in the United States to qualify for use in the BEAD program. To ensure conformity with the waiver, the National Telecommunications and Information Administration (NTIA) has created a self-certification and compliance framework for manufacturers.
As part of this process, manufacturers must certify compliance with BABA requirements under penalty of law, as defined by the Program Fraud Civil Remedies Act (31 U.S.C. § 3801 et seq.), the False Claims Amendments Act of 1986, and the False Statements Accountability Act of 1996 (18 U.S.C. §§ 287 and 1001). In accordance with this framework, Caban Energy certifies that its products meet the domestic manufacturing requirements outlined in the BABA waiver.
